Lawmakers Confront DHS Over 'Domestic Terrorist' Labels and Surveillance Tech Usage

More than a dozen Democratic lawmakers have sent a formal letter to the Department of Homeland Security (DHS) demanding transparency regarding the agency's classification of U.S. citizens as domestic terrorists. Led by Rep. Bennie G. Thompson, the lawmakers are questioning the criteria used to apply this label, particularly following the deaths of individuals designated as such by DHS officers.


The correspondence accuses the agency of operating invasive surveillance tools to identify targets without sufficient evidence. The lawmakers argue that the DHS is weaponizing technology to stifle dissent, creating a cycle where surveillance powers are expanded under the guise of security concerns.


Expanding Surveillance Infrastructure


A significant portion of the letter focuses on the technical infrastructure currently deployed by DHS and its component agencies, such as ICE. The lawmakers cite multiple reports detailing the acquisition and use of advanced monitoring technologies. These include the purchase of smartphone location data, which allows agencies to track individuals without a warrant, and the use of facial recognition technology to identify legal observers and protesters.


Additionally, the letter highlights the use of a tool developed by Palantir known as ELITE. This system reportedly provides ICE with 'confidence scores' regarding the addresses of targeted individuals, raising questions about the reliability and human oversight of algorithmic decision-making in law enforcement.


Calls for Accountability


The representatives argue that the department is leveraging sensitive information obtained from tech companies to unmask critics, blurring the line between national security and the suppression of free speech. The letter demands documentation of the legal regime governing these surveillance powers and the specific technical policies in place.


Lawmakers have requested a clear definition of the term 'domestic terrorist' and a description of the consequences associated with such a designation. The letter concludes by characterizing the current DHS practices as 'abhorrent' and 'blatantly unconstitutional,' warning of the dangers posed by an authoritarian surveillance state.
