Nintendo Escalates War on Emulation: DMCA Notices Hit All Switch Emulators on GitHub

Nintendo has initiated a sweeping legal offensive against Nintendo Switch emulation, issuing DMCA takedown notices to nearly every emulator repository hosted on GitHub. The action targets a broad spectrum of software, ranging from active projects like Citron, Eden, and MeloNX to discontinued efforts such as Sudachi.


Although these repositories remain online at the time of reporting, GitHub is expected to comply with the takedown requests shortly. This aggressive move follows a period of relative quiet after the high-profile settlements that shut down Yuzu and Ryujinx last year.


Legal Context and Developer Response


Nintendo’s legal argument focuses on the circumvention of technological protection measures (TPMs), specifically the cryptographic keys used to decrypt game files. While modern emulator forks do not bundle these keys or copyrighted games, Nintendo asserts that the software's primary function facilitates piracy, a point of contention that remains legally untested in court.


Despite the impending removal from GitHub, the impact on development may be limited. Anticipating such a crackdown, many teams have mirrored their repositories on private external servers. This ensures the projects' survival but risks driving less tech-savvy users toward unsafe download sources.
